The petitioner seeks bail in connection with Gopalganj Town (Gopalganj) P.S. Case No.347/16 registered under Sections 272, 273 of the Indian Penal Code, Section 47(A) of Excise Act and Section 57 of Bihar Excise Amendment Act. Learned counsel for the petitioner submits that it would appear from the F.I.R. that one Bandaku Ram was admitted in the hospital after taking liquor who disclosed the name of 40 persons including the petitioner who used to sell the illicit liquor but neither the house of the petitioner was searched nor any incriminating article was recovered from the house of the

In fact, Kanhaiya Pasi son of the petitioner used to sell liquor due to which the petitioner has been falsely implicated in the present case and the petitioner is in custody since 9.8.2016. Further submission is that the petitioner is accused in Gopalganj P.S. Case No.348/16 for the offence under Sections 328, 304, 120(B)/34 of the I.P.C. and Section 50(a) (b) (c) Bihar Excise Amendment Act, 2016 which is of the same occurrence. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Gopalganj Town (Gopalganj), P.S. Case No.347/16.
