The sole petitioner, who is in custody in Industrial P.S. Case No.19/2016 registered for the offence under Section 366(A), 494/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case and he is rotting in jail since 18.04.2016, whereas Mr. Matloob Rab, learned Addl. Public Prosecutor, opposing the prayer for bail of the petitioner, submits that it was a case, in which the petitioner, who is married and is having one child, has committed rape with minor girl after her kidnapping.
Patna High Court Cr.Misc. No.34755 of 2016 (2) dt.22-08-2016 2/2 Keeping in view the nature of accusation, I do not find any ground to extend the privilege of bail. The petition stands dismissed.
