This application is for grant of regular bail in connection with Saurbazar (B.Pur) P.S.case No.133 of 2016, for the offences under Sections 366(A) and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the daughter of the informant.

It is submitted on behalf of the petitioner that he has been falsely implicated in this case as he is 'Bhagin Damad' of the informant and the F.I.R. itself shows that the informant is not sure about the kidnapping and the petitioner also tried to find out the girl by visiting at Nepal and his Mobile Number is also mentioned but there is nothing against him except the suspicion. The petitioner is in custody since 23.09.2016.

Heard learned A.P.P. also, who has opposed the prayer for

Patna High Court Cr.Misc. No.14124 of 2017 (6) dt.16-05-2017 2/2 bail stating the victim girl has not been recovered up-till-now. Having heard both sides and in view of submission as well as the fact that still the girl has not been recovered, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail after framing of charge in this case.

With the aforesaid observation, this application is dismissed.
