The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, on 22.06.2021 at about 4:00 PM, on account of old land dispute between the parties, the F.I.R. named accused persons including these petitioners
Patna High Court CR. MISC. No.72372 of 2021(2) dt.20-07-2022 2/2 abused and assaulted informant and others with farsa, lathi and iron rod, as a result of which, they sustained injury. It is submitted on behalf of petitioners that the injury sustained by informant and his nephew are simple in nature. Due to land dispute, a simple Maarpit took place between the parties. There is no specific allegation of assault against these petitioners. Petitioners have got clean antecedent Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, Motihari, East Champaran in connection with Sangrampur P.S. Case No. 150 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
