JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-04-2024 The present writ petition has been filed seeking the following reliefs:- "1. i. For issuance of an appropriate writ/s, order/s, direction/s in the nature of MANDAMUS commanding and directing the respondent to grant promotion to the petitioners to Upper Division Clerk in view of the letter no.
5838 dated 22.06.2022(Annexure-1) issued under the signature of Secretary (Resource), Finance Department Government of Bihar as petitioners have been serving for more than ten years on the post of Lower Division Clerk while letter no. 5838 dated 22.06.2022 prescribes that those clerk who has completed the period of 6 years or more as Lower Division Clerk shall be promoted to the post of Upper Divisional Clerk.
ii. For issuance of an appropriate writ in
Patna High Court CWJC No.16883 of 2022(2) dt.05-04-2024 2/2 the nature of Mandamus commanding and directing the respondent to grant the benefit of Assured Career Progression (for short "A.C.P.") to the petitioners as they have already completed 10 years of service as clerk in district welfare office department government of Bihar as per rules contained in ACP Rules 2010 as many other similarly situated employee working as clerk in different district welfare offices in Bihar have already been accorded the same benefit vide memo no. 5235 dated 30.08.2016 (Annexure No. 4)."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no. 2 i.e. The Director, Schedule Caste and Schedule Tribe Welfare Department, Government of Bihar, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands disposed off as not pressed.
