The Petitioner seeks bail in Barachatty P.S.

Case No. 490 of 2016 instituted for the offence under Section(s) 420, 467, 468, 471, 414, 120B of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner is driver of the truck from which the alleged coal has been recovered.

It is alleged in the written report that one truck loaded with coal was intercepted by the police which was driven by this petitioner. The petitioner produced the required papers before the police showing that the same was to be unloaded to M/S Laxmi Industry.

No.14605 of 2017 (2) dt.20-04-2017 2/2 The police has mentioned in the written report that the papers produced by the petitioner and the statement made before the police has created confusion to the police. It has been submitted on behalf of the petitioner that the papers produced by the petitioner were genuine papers but due to confusion, the petitioner has been arrested. The petitioner is said to be in custody since 01.12.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghaty, Gaya in connection with Barachatty P.S. Case No. 490 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
