The present writ application has been filed for quashing the order dated 15.12.2016 passed in Case No. 03 of 2016, as contained in Annexure-6, issued by Respondent No. 03, Assistant Inspector General, Registration, Purnea Division,

Patna High Court CWJC No.4520 of 2017(2) dt.18-09-2018 2/3 whereby the petitioner has been directed to deposit deficit stamp, penalty and in case of the non payment of the said amount, within sixty days of the passing of the impugned order, interest at the rate of 5% per month for delayed payment has been directed.

After some argument, Mr. Amal Kumar Sinha, learned counsel for the petitioner seeks permission to withdraw the present writ application to avail the remedy before appropriate forum.

Permission is accorded.

In the circumstance, the present writ application is disposed of as withdrawn with aforementioned liberty to the petitioner.

If such appeal is filed along with an application for condonation of delay within a period of three weeks from the date of receipt/production of a copy of this order, the Appellate Authority will consider the same in accordance with law keeping in view the fact that the writ application was pending before this Court.

In the meantime, for the next four weeks, let no coercive steps be taken against the petitioner in pursuance to order dated 15.12.2016 passed in Case No.03 of 2016, as
