JUSTICE BIRENDRA KUMAR ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341/323/379/307/504/498A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Petitioner is husband of the informant.

There is allegation of demand of dowry and torture for the same against the petitioner. Reconciliation has already failed.

Considering the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the

Patna High Court Cr.Misc. No.13718 of 2017 (3) dt.19-05-2017 2/2 petitioner, in connection with Mali Police Station Case No. 6 of 2017, pending in the court of learned Chief Judicial Magistrate, Aurangabad/Successor Court. However, if the petitioner agrees for company of the wife, the Court-below shall dispose of the regular bail application without being prejudiced by the order of this Court.

Accordingly, the prayer for anticipatory bail is refused. (Birendra Kumar, J) Mkr./- U T
