The petitioner is in custody in connection with a case registered under Sections 414/34 of the Indian Penal Code. The petitioner is named in the FIR and there is recovery of Lap Top and other articles, which is evident from seizure list. It has been submitted on behalf of the petitioner that the petitioner has got clean antecedent and he is in custody for about four months. It is further submitted that the seizure list does not bear the signature of the petitioner or his family members. Heard learned A.P.P. also, who opposes the prayer for bail.

In view of the submission of the petitioner that the petitioner is in custody for about four months and further in view

No.13970 of 2017 (3) dt.18-04-2017 2/2 of the fact that the petitioner has got clean antecedent and also in view of the fact that the seizure list does not bear the signature of the petitioner or his family members let, above named petitioner, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Araria P.S.Case No. 881/2016,subject to the conditions that :- (i) one of the bailors of the petitioner shall be a local persons having sufficient immovable properties within he jurisdiction of the concerned Court.

(ii) the petitioner will not induce any witness or tamper with the evidence.

(iii) the petitioner shall co-operate in the disposal of the trial and make himself available as and hen required by the Court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail bonds.
