====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in connection with Rafiganj P.S. Case No. 74 of 2021 registered under Sections 414, 467, 468, 471 and 34 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 07.03.2021, charge-sheet has been submitted in the case, has antecedent of one case and the informant alleges that the petitioner along with Rohan were apprehended based on secret information, further they disclosed that they belong to Kodha Gang and use stolen motorcycle for the purpose of snatching money from people who withdraw money from the banks.
The learned counsel submits that the petitioner has
Patna High Court CR. MISC. No.244 of 2022(2) dt.16-05-2022 2/2 been falsely implicated in the present case, it is submitted that based on his own confession he has been implicated and is in custody more than one year.
The learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 07.03.2021, charge-sheet has been submitted in the case and in the nature of allegation, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rafiganj P.S. Case No. 74 of 2021 with a condition that one of the bailors shall be the uncle of the petitioner namely Nand Lal Yadav.
Further, if the learned court below comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned court below shall forthwith cancel his bail bond after recording reason.
