2. Petitioner apprehends arrest in a case registered for the offence punishable u/s 25(1-AA), 26, 35 of Arms Act and under Section 20(b)(ii)(B) of the N.D.P.S. Act.

3. Petitioner has been named by co-accused who was apprehended on the spot with arms and ammunition and smack.

4. Learned counsel appearing for the petitioner submits that petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner,

No.64189 of 2023(2) dt.17-10-2023 2/2 mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge cum Sessions Judge, Muzaffarpur in NDPS Case No. 134 of 2021/Ahiyapur Police Station Case No. 640 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
