No. 33347 of 2015 to the extent that the alleged sale deed was not executed by the petitioner rather petitioner was only witness to the sale deed executed by one Smt. Usha Sinha. The order dated 11.08.2015 passed in Cr.

Misc. No. 33347 of 2015 is modified to the extent that petitioner did not execute the sale deed in favour of the complainant rather he was mediator and a witness to the sale deed executed by one Smt. Usha Sinha.

Hence, in the circumstance, the prayer for extending the period for surrender is also extended for a further period of four weeks from the date of receipt/production of the order of this Court.

Accordingly the modification application is

Patna High Court Cr.Misc. No.43327 of 2015 (2) dt.30-09-2015 2/2 disposed of in connection with Complaint Case No. 723C of 2013, pending in the Court of learned Chief Judicial Magistrate, Biharsharif.
