2. The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366(A) and 506/34 of the Indian Penal Code.
3. The prosecution case, in brief, as per the written application of the informant Shashi Devi, is that on 17.03.2024 at about 4:00 AM, this petitioner and other co-accused persons forcibly kidnapped her minor daughter for the purpose of marriage or force her into wrong act. Informant has further alleged that she was also threatened from mobile no. 9117981322 to face dire consequences if she lodges any case.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely on suspicion. He is simply a victim of false implication due to oblique and political grudge. In fact, there was love affairs
Patna High Court CR. MISC. No.61948 of 2025(3) dt.14-10-2025 2/2 between petitioner and victim girl. The victim, in her statement recorded under Section 183 B.N.S.S., has not supported the prosecution case and denied the factum of kidnapping, rather she has stated that she left her house out of her own sweet will, as her parents wanted to marry her with an aged person. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, East Champaran, Motihari in connection with Govindganj P.S. Case No. 128 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
