This application for anticipatory bail arises out of Chandramandih P.S. Case No. 27 of 2019, disclosing the offence under Sections 406, 409, 420 of the Indian Penal Code. The petitioner is husband of Mukhiya of Gram Panchayat Nawadih Silgiri. It is alleged against the persons named in the FIR including this petitioner that he used to demand illegal money for providing the beneficiaries, benefits under Pradhan Mantri Awas Yojna.

Learned counsel appearing on behalf of the petitioner has submitted that he did not have any authority to do any favour and he has been falsely implicated out of local political rivalry. He has also submitted that in case the petitioner is found

Patna High Court CR. MISC. No.57812 of 2019(2) dt.13-09-2019 2/2 to be facing any prosecution in future of similar nature, after having granted privilege of anticipatory bail by this Court, his bail bonds may be cancelled.

Considering the above submission, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui, in connection with Chandramandih P.S Case No. 27 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bounds shall be liable to be cancelled.
