This is an application for bail in connection with Shyampur Bhattha P.S.Case No. 71 of 2011 registered for the offences punishable under Sections 147, 148, 149, 324, 341, 302 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is of firing on the deceased and the case is under Section 302 and other sections of the IPC.

It has been submitted on behalf of the petitioner that now the trial has commenced and three witnesses have been examined, including the informant, who were turned hostile, as such, no purpose will be served in keeping the petitioner behind bars.

Patna High Court Cr.Misc. No.13122 of 2017 (3) dt.03-05-2017 2/2 Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and considering the fact that trial has now commenced and three witnesses have been examined, the learned trial court is directed to expedite the trial and try to conclude the same within a period of seven months. This application is dismissed with the above observations.
