JUSTICE SUDHIR SINGH ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-b) a ad 26 of the Arms Act.

Allegation against the petitioner is that he started fleeing away on seeing police personnels but was apprehended and from his possession one country made pistol and four live cartridges are said to have been3 recovered.

It has been submitted on behalf of the petitioner that he is in custody since 18.4.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. One country made pistol and four live cartridges are said to have been recovered from the possession of the petitioner. No compliance of Section 100 Cr. P.C. has been made.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.41607 of 2015 (3) dt.30-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar Singh-1, Addl. Sessions Judge-VIII, Begusarai in connection with Shahebpur Kamal P.S. Case no. 173 of 2015 giving rise to S.T. no. 1213 of 2015.
