JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.

The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she specifically stated that she was kidnapped and raped by the petitioner. The impugned order goes to show that charge against the petitioner has already been framed and the trial of the petitioner has already commenced. Regard being had to the above stated facts and circumstances, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Town P.S. Case

Patna High Court Cr.Misc. No.37101 of 2016 (3) dt.25-10-2016 2/2 No. 86 of 2014 pending in the court of 1st Additional Sessions Judge, Samastipur stands rejected.

However, the trial court should expedite the trial of the petitioner.
