JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-02-2020 This modification application has been preferred on behalf of the North Bihar Power Distribution Company Ltd. which is one of the companies formed after dissolution of the Bihar State Electricity Board.
Learned Senior Counsel for the present petitioners submits that C.W.J.C. No. 16060 of 2013 was filed in the year 2013 but by that time the Bihar State Electricity Board had been
Patna High Court MJC No.3575 of 2019(3) dt.19-02-2020 2/3 dissolved and North Bihar Power Distribution Company Ltd. which was one of the subsidiaries company of the Bihar State Power Holding Company Ltd. was formed and, therefore, the name of the respondents were required to be amended in the writ application which was not done and at the time of passing of the order dated 02.01.2019 these facts were brought to the notice of this Court and then it was submitted that the Company shall consider the claim of the petitioners and shall take a decision thereon within a reasonable time.
At that point of time it could not be informed to the Court that there is no post of General Manager-cum-Chief Engineer, Muzaffarpur, Electric Supply Circle, Muzaffarpur and, therefore, this Court issued a direction taking as the said post is available.
Learned Senior Counsel submits that in fact the competent authority to consider the claims of the petitioners would be the Deputy General Manager-cum-Electrical Superintending Engineer, Muzaffarpur, Electric Supply Area, Muzaffarpur and hence, the direction should go to that authority. In the aforesaid view of the matter, let the Deputy General Manager-cum-Electrical Superintending Engineer, Muzaffarpur, Electric Supply Circle, Muzaffarpur be added as
Patna High Court MJC No.3575 of 2019(3) dt.19-02-2020 3/3 party respondent no. '9' in the main writ petition. The direction which has been earlier issued to the General Manager-cum Chief Engineer, Muzaffarpur, Electric Supply Circle, Muzaffarpur shall now be read as direction to the Deputy General Manager-cum-Electrical Superintending Engineer, Muzaffarpur, Electric Supply Circle, Muzaffarpur and now the said authority shall pass a reasoned order within a period of 90 days from today.
