ANSHUMAN ORAL ORDER 12-04-2023 Learned counsel for the petitioner has filed the present criminal miscellaneous petition for modification in the name of father of the petitioner. Counsel submits that due to inadvertence, the name of petitioner's father was typed as Mahesh Paswan in criminal miscellaneous no. 18577 of 2022 instead of correct name Umesh Paswan.

After passing order on bail, counsel realised this problem. Since, this defect could not be removed under heading to be mentioned due to the reason that name has wrongly typed in the petition itself and the said criminal miscellaneous case has already been disposed of. It is therefore, he has filed the present application under Section 164 of Cr.P.C. and request to this Court that an order may be passed in this regard that the name

Patna High Court CR. MISC. No. 24947 of 2023(2) dt.12-04-2023 2/2 of petitioner's father is Umesh Paswan and not Mahesh Paswan. In this view of the matter, the present criminal miscellaneous petition is allowed only upto the extent that the petitioner's name Krishna Paswan aged about 26 years, son of Umesh Paswan who is accused of Aurangabad (Muffasil) P.S. Case No.21 of 2021 and Krishna Paswan aged about 26 years, son of late Mahesh Paswan is one and the same person only due to the mistake on the part of the counsel instead of correct name Umesh Paswan, Mahesh Paswan has been typed.

The order passed in Cr. Misc. No.18577 of 2022 has been modified after direction and the Krishna Paswan, son of Umesh Paswan as mentioned in Cr. Misc. No.24947 of 2023 and Krishna Paswan son of Umesh Paswan in Cr. Misc. No.18577 of 2022 are related to the same Aurangabad (Muffasil) P.S. Case No.21 of 2021 and will be treated as one and the same.

With this direction, this Cr. Misc. Application is hereby modified.
