JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are in custody in a case registered under Section 302 read with 34 of the Indian Penal Code. According to the prosecution case, it was co-accused Dhananjay Mallah, who gave tangi blow on the head of the deceased. So far petitioners are concerned, no specific overt act has been attributed against them and having more or less similar allegation, one co- accused, namely, Chhotu Mallah has been granted bail by this Court, vide order dated 28.08.2015 in Cr.Misc. No.34662 of 2015.

Considering the facts and circumstances of the case, let above named petitioners be released on bail on furnishing
