JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This is an application for grant of anticipatory bail in connection with Warisaliganj P. S. Case No.227 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that the police on information of manufacturing of illicit liquor, raided the Badhar and recovered 78 liters of country made liquor and several persons including the petitioners succeeded in fleeing away from the spot. Submission of the learned counsel for the petitioners is that their names have been disclosed by the co-accused persons, who were apprehended at the place of occurrence and except that there is nothing against them. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.D.J.-II-cum-Special Judge, Nawada, in connection with Warisaliganj P. S. Case No.227 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
