JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 03-04-2016 Heard Mr. Santosh Kumar learned counsel for the petitioner and learned counsel for the State and Mr. Ranjeet Kumar Pandey learned counsel for the Patna Municipal Corporation. The petitioner while questioning the last pay certificate issued by the Urban Finance and Accounts Controller, Patna Municipal Corporation, Patna vide Memo No. 5716 dated 20.5.2016 present at Annexure-4 claims that he has been paid less than the amount to which he was entitled to. Mr. Santosh Kumar learned counsel for the petitioner admits that although that he had earlier come before this
Patna High Court CWJC No.13805 of 2016 dt.03-04-2016 2 / 2 Court in C.W.J.C.No.21002 of 2014 for claiming salary as well as last pay certificate but since the amount of salary as found admissible by the Corporation, was paid to him that the writ petition was disposed of with the direction to the Corporation to issue last pay certificate. He submits that it is on examination of the details of the arrears of salary paid to the petitioner amounting to Rs. 16,08,122/-, a copy of which is placed at Annexure-2 as well as the last pay certificate at Annexure-4 that it transpired that the petitioner has been paid amount lesser than what he was entitled to, that he filed a representation before the Urban Finance and Accounts Controller of the Corporation vide Annexure-5 enclosing his calculations but which has remained pending.
Having heard learned counsel for the parties and considering the nature of grievance raised, I deem it proper to dispose of the writ petition with the direction to the Urban Finance and Accounts Controller, Patna Municipal Corporation to consider the grievance of the petitioner as raised vide Annexure-5 and to dispose of the same by speaking order within three months from the date of receipt/production of a copy of this order.
