JUSTICE SANJAY PRIYA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners seek anticipatory bail in a case instituted for the offence under Sections-328, 307 & other minor sections of the Indian Penal Code.

It has been submitted that petitioners are family members of husband of the informant. There is general and omnibus allegation against these petitioners. From the written report, it appears that there is general and omnibus allegation against these petitioners that they administered poisonous water to the victim girl. Besides this, there is no allegation against the petitioners. It has been submitted that

Patna High Court Cr.Misc. No.13115 of 2017 (3) dt.04-04-2017 2/2 earlier the victim girl married to Sanjay Kumar Pandit in the year, 2008.

Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kahalgaon (Rasalpur) Case No. 462 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur subject to conditions as laid down u/S 438(2) of the Cr.P.C.
