Application is for grant of anticipatory bail in Hisua P.S. Case No. 85 of 2016 registered under sections 341, 323, 447, 337, 379, 307, 504 and 506/34 of the Indian Penal Code. Petitioner is named accused of the case. It is alleged that when the petitioner and another accused were coming in drunken condition, the informant objected to the demeanor of the accused person. Enraged thereby, it is alleged that the petitioner rushed to his house and brought iron rod and assaulted on the head of the informant.

Contention of the petitioner is that both parties are gotiyas. They are locked in land dispute. The informant received lacerated injury on head which has been opined as minor and

Learned APP opposed the prayer and submits that the injury sustained by the informant supports the prosecution case.

Looking to the allegation and other materials reflected from the records, I am not persuaded to privilege the petitioner with anticipatory bail. Prayer is rejected. (Kishore Kumar Mandal, J) Pankaj/- U T
