2. Petitioners apprehend his arrest in a case registered for the offence punishable under sections 91(1),126(2),115(2),118(2),303(2)109, of the B.N.S. and 27 of Arms Act.
3 . As per the prosecution case , informant namely , Anirudh Choudhari alleged that on on 22.10.2024 at about 6 PM , when he war returning home , in the meantime , all the F.I.R. named accused persons including these petitioners armed with various arms and weapons caught hold of informant
Patna High Court CR. MISC. No.63000 of 2025(2) dt.10-09-2025 2/3 and upon the order of petitioner No. 1 , co-accused Munna Choudhary assaulted on head of informant with farsa . It is further alleged that Petitioner No. 1 fired upon informant but somehow he managed to save himself and thereafter, petitioner No. 3 snatched his vehicle .
4. It is submitted on behalf of the petitioners that petitioners are innocent and have committed no offence as alleged. Specific accusation of assault is against co-accused Munna Choudhary . So far as, these petitioners are concerned there is general and omnibus allegation of assault against them. Rest of the allegations are ornamental in nature to make the case grave . Injuries sustained by informant is simple in nature . 5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, nature of injury and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Champaran. Bettiah West Champaran in connection with Bairiya ( Bettiah Town) PS Case No. 366 of 2024 ,
