JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of robbery is against unknown. First the petitioner was apprehended by the police without collection of any material against the petitioner and thereafter his confessional statement was recorded.
Submission is that besides confession there is no other material against the petitioner including any recovery and the petitioner is in custody since 24.08.2016. Considering the facts aforesaid, let petitioner,
Patna High Court Cr.Misc. No.12872 of 2017 (2) dt.21-03-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Gaya/Successor Court, in connection with Magadh Medical P.S. Case No.128 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
