JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 341, 323, 324, 308, 379, 504/34 of the Indian Penal in Bihiya P.S. Case No.45 of 2014. It is alleged that the petitioner assaulted Rajat Kumar on his head with farsa.

The petitioner submits that the occurrence took place at the spur of the moment while the prosecution side was going to dispose of the idle of Goddess Saraswati.

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. The petitioner should surrender and pray for regular bail, which would be disposed of on its own merit. With the aforesaid observations and directions, this application stands disposed of.
