JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-307 & other minor sections of the Indian Penal Code. There is allegation against the petitioner that he opened fire, causing grievous injury on the mandible of informant's son but submission on behalf of petitioner is that it was prosecution party, who assaulted the petitioner's wife and son and the petitioner's wife sustained grievous injury on her head and for the aforesaid occurrence, the son of the petitioner lodged Dawath P.S. Case No. 32 of 2016.

Learned counsel, appearing for informant opposed the prayer for bail of the petitioner, submitting that the injured of

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioner does not have any criminal antecedent and the investigation against him has already been completed., let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dawath P.S. Case No. 31 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, Rohtas.
