2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 420, 467, 468, 471, 34 of the Indian Penal Code and Section 30(a) of Bihar Probibiton of Excise Act, 2016.
3 As per FIR. it is a case incriminating wine from the pick up van.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. It is further submitted that the name of the petitioner came into light on the basis of confessional statement of accused person who apprehended on spot who disclosed the name of the petitioner. The petitioner is in custody since 05.08.2023. The apprehended
Patna High Court CR. MISC. No.65457 of 2023(2) dt.13-10-2023 2/2 accused person enlarged on bail by this Court vide order dated 31.08.2023 passed in Cr. Misc. No. 55204 of 2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-II(Excise Act), Darbhanga in connection with Bahera P.S. Case No. 181 of 2023.
