It appears from the record that the Office has placed a note stating therein that brief of the present case could not be found in the Section and even after a hectic search, the file could not be traced. Accordingly, a dummy file has been prepared and has been placed before the Bench along with two to three pages of order sheets. No petition and anenxures are there in the file.

3. Learned Senior counsel appearing for the Bank submits that the file of the case is also not available with him. Since nobody is appearing on behalf of the petitioner and the matter is very old, then the present writ petition can be disposed of with liberty to the petitioner to move an appropriate

Patna High Court CWJC No.2315 of 2012(3) dt.19-02-2024 2/2 application, in case, the petitioner would be of the opinion that the matter is still alive and requires adjudication.

5. In such view of the matter, this writ application is disposed of with liberty to the petitioner to file a fresh writ application if the grievance of the petitioner is alive and still subsists.
