JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Ara Nawada P.S. Case No.271/16 registered under Sections 419, 420, 406, 504, 467, 468 of the Indian Penal Code.

The allegation of the informant is that he has visiting term with Ranjit Kumar Rai who told him that his grand father Banarsi Rai is intending to sell his house. Thereafter the informant talked to Banarasi Rai who agreed to sell his house and the informant became ready to purchase his house on payment of Rs.25,00,000/- . Accordingly the informant gave Rs.21,00,000/- to Ranjit Kumar Rai and agreement was prepared on non-judicial

Patna High Court Cr.Misc. No.14262 of 2017 (2) dt.08-04-2017 2/2 Stamp in that regard and it was decided that remaining amount rupees four lacs will be paid at the time of registry. But neither the sale deed was executed nor they returned Rs.21,00,000/- as taken in advance.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the informant had given Rs.21,00,000/- to the grand father of the petitioner. The petitioner has no criminal antecedent and he is in custody since 22.12.2016. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.,Ara, in connection with Ara Nawada P.S.
