JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but his name surfaced in this case in course of investigation and he was remanded on 4.12.2015. The confessional statement of petitioner was recorded and on the basis of confessional statement some stolen mobiles are said to have been recovered. Submission on behalf of the petitioner is that nothing has been recovered from conscious possession of the petitioner and moreover, the recovered mobiles have not been put on T.I.P and, therefore, it cannot be said that recovered mobiles are stolen property.
Accordingly, let the petitioner, above named, be
Patna High Court Cr.Misc. No.36539 of 2016 (2) dt.30-08-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S.Case No. 127 of 2015.
