The petitioners apprehend their arrest in Karamchat P.S. Case No. 56 of 2016 instituted for the offence under Section (s) 302/34 of the Indian Penal Code and Section 3(1)(r)(s) of the SC & ST (Prevention of Atrocities) Act. It is alleged in the written report that informant got information that his son has been killed and his dead body has been thrown in village-Majhiyaon. The informant has raised suspicion against the petitioners.
It has been submitted on behalf of the
Patna High Court Cr.Misc. No.14024 of 2017 (2) dt.27-03-2017 2/3 petitioners that one government land which has been settled in the name of the informant and his family members was the only source of outlets of waste water and rain water of the house of the petitioners for which the petitioners filed a petition before the authority for cancellation of said settlement which caused annoyance to the family members of the informant and therefore, the informant falsely implicated the petitioners in this case. From the impugned order, it appears that the statement of the witnesses in para 21, 22, 24 has been recorded wherein they stated that there is land dispute between the parties and threat was given by the accused persons and one day prior to the occurrence, the deceased was seen along with petitioner No. 3.
It has been mentioned in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Karamchat P.S. Case No. 56 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned
