JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sadar (Muffasil) P.S. Case No. 128 of 2019 registered for the offences punishable under Sections 419, 420 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he got some other person appeared in his place in SSC G.D-2019 Examination.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the person who has appeared in the examination in his place has been granted bail by the court below itself and petitioner is a student and he is ready to abide by any condition that may be imposed on him.

Heard learned APP also.

No.58015 of 2019(2) dt.13-09-2019 2/2 In view of above facts and circumstances, let petitioner surrender in the court below within two weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Sadar (Muffasil) P.S. Case No. 128 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be his father or mother and further petitioner has to appear before the I.O. as and when required, otherwise his bail bonds shall be cancelled.
