2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302/120B/34 of the Indian Penal Code as well as sections 3 and 4 of the Prevention of Witch practices Act.

3. As per prosecution case, informant suspects that this petitioner and two other unknown accused persons killed his mother.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. During investigation, none of the witnesses have seen the petitioner committing the alleged offence. Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 40405/2025. Petitioner claims clean antecedent and he is in custody since 14.10.2023.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the nature of accusation, materials collected during investigation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District and Additional Sessions Judge III, Katihar in Sessions Trial No. 188 of 2024.
