This is an application for bail in connection with Singhia P.S.Case No. 100 of 2014 registered for the offences punishable under Sections 328 and 304B/34 of the Indian Penal Code.

Petitioner is the husband and the case is dowry death. Allegation against the petitioner and other accused persons is of administering poison and causing her death.

It has been submitted on behalf of the petitioner that there is general and omnibus allegation and no specific allegation is attributed against the petitioner and he is in jail for two and a half years.

Heard learned APP also, who has opposed the prayer for bail.

No.14552 of 2017 (3) dt.16-05-2017 2/2 Having heard both sides and considering the aforesaid facts and circumstances and also considering the report of Forensic Science Laboratory, which was called for, that Alluminium Phosphide was detected, which is commercially known as Celphos, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody for two and a half years, learned trial court is directed to expedite the commitment of the case, if not committed, and also expedite the trial of the petitioner and other accused persons and try to conclude the same within a period of nine months and at the same time Superintendent of Police, Samastipur, is also directed to ensure that witnesses are present in court on the date fixed, so that the trial is concluded within the said period. Accordingly, this application is dismissed with the above observations.
