JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioners and the State. The petitioner no.1 being the husband of the informant and petitioner no.2 being the girl against whom it is alleged that she has illicit relationship with petitioner no.1, are apprehending arrest in a case registered for the offences punishable under Sections 498A and 494 of the Indian Penal Code. The basic accusation is of torture and performing second marriage.
It is submitted by learned counsel for the petitioners that informant and petitioner no.1 has entered into compromise and a petition to that effect has been filed before the learned court below, the same has been brought on record as Annexure-2. The petitioner no.1 and the informant have filed Matrimonial Suit No. 113 of 2015 under Section 13(B) of the Hindu Marriage Act on
Patna High Court Cr.Misc. No.45078 of 2015 (2) dt.22-09-2015 2/2 06.04.2015.
In the above circumstance, Mr. Lal Babu Singh, learned counsel for the informant submits that he is not opposing the prayer for bail of the petitioners.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Darbhanga in connection with Simri P.S. Case No. 16 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
