The petitioners apprehend their arrest for the offences alleged under Section 302/34 of the Indian Penal Code registered in connection with Bajopatti P.S.Case No. 85 of 2021. As per allegation, the petitioners, who are named in the FIR, entered into the house of the informant and badly assaulted her father-in-law and made him injured. Her father-inlaw died at the spot due to indiscriminate assault at the hands of the petitioners.
The learned counsel for the petitioners has submitted that they are innocent and have falsely been implicated in this case because one day prior to the occurrence Sushila Devi had lodged Bajopatti P.S.Case No. 84 of 2021 against the members of the informant's side and due to that vendetta, the present case has been lodged.
Petitioners are named in the FIR. There is allegation against them that they badly assaulted the father-in-law of the informant who died at the spot. The informant is an eye-witness of the occurrence.
Considering the above mentioned facts and circumstances, petitioners do not deserve the privilege of anticipatory bail, which is hereby rejected.
Patna High Court CR. MISC. No.1319 of 2022(2) dt.04-08-2022 3/3 Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
