The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354 and 354(B) of the Indian Penal Code.

The prosecution case is that the petitioner and one Yogendra Manjhi were taking the daughter of the informant after putting cloth on her mouth when the daughter of the informant raised alarm then the villagers went to rescue then the accused persons escaped from the scene.

It is submitted by learned counsel for the petitioner that the petitioner is co-villager of the informant and even assuming the accusation in the FIR no offence under

Patna High Court Cr.Misc. No.42790 of 2015 (2) dt.13-10-2015 2/2 Section 354(B) IPC is made out as there is no accusation of disrobing the daughter of the informant and section 354 IPC is bailable.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Gaya in connection with Gaya Muffasil P.S. Case No. 453 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
