The petitioner seeks bail in Vijayeepur case No. 160 of 2016 under Section 363/366A and 34 of the Indian Penal Code. The informant alleged that while her daughter had gone to attend the call of nature, three persons, namely, Chunnu Turha, Pappu Turha and Sohan Turha, the petitioner, kidnapped her on a motor cycle with the help of other accused persons. The learned counsel for the petitioner submits that the victim was in love with Chunnu Turha and she voluntarily left her house and solemnized marriage with Chunnu Turha. The doctor assessed the age of the victim between 17-18 years. The victim also made her statement under Section 164 of the Cr. P. C. stating that the accused persons kidnapped her but she became

Patna High Court Cr.Misc. No.14073 of 2017 (3) dt.10-05-2017 2/2 unconscious.

Considering the facts that victim went along with Chunnu Turha and others but she did not raise any objection on her way to different places, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Vijayeepur P.S. Case No. 160 of 2016.
