====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-02-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.

Allegedly, petitioner, along with other accused persons, has committed murder of the informant's sister, due to nonfulfillment of demand of four wheeler vehicle. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to malafide intention. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. It is further submitted that the petitioner is

Patna High Court CR. MISC. No.66730 of 2022(2) dt.25-02-2023 2/2 doing service in North East Railway in Varanasi Division and is posted at Vasadwa Railway Station. He further submits that after the marriage, the informant's sister had been living with the petitioner. It is further submitted that the informant's sister was blessed with one daughter and one son and when she again became pregnant, for better care, she came to native house of the petitioner. He further submitted that at the time of death of the informant's sister, the petitioner was not present at his native house. He came to know about the death of the deceased during the period of his journey. Petitioner has no criminal antecedent as mentioned in para-3 of this application. Learned APP for the State opposed the prayer for bail by submitting that the petitioner along with other accused persons, in furtherance of the common intention, have committed murder of the informant's sister, due to non-fulfillment of the dowry demand.

Considering the facts and circumstances of case, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected.
