JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 307 and other allied sections of the Indian Penal Code ad section 27 of the Arms Act. As per the prosecution case, this petitioner along with other FIR named accused persons made indiscriminate firing as a result of which wife of the informant sustained three bullet injuries.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation of resorting to firing against all the accused persons and no specific overt act has been alleged against the petitioner. FIR has been lodged after delay of 29 days and there is no plausible explanation of

Learned counsel for the State opposes the prayer for bail and submits that there is direct and specific allegation against the petitioner of causing fire arms injury to the wife of the informant and doctor has found three fire arms injuries on the body of the victim which were grievous in nature. Considering the nature of accusation against the petitioner and the nature of injuries sustained by the victim, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) shashi/- U T
