JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.

Prosecution case is that some unknown miscreants looted valuable articles worth Rs.5 lacs from the house of the informant and they also assaulted wife of the informant. The name of the petitioner has come on the basis of confession of the co-accused. It has been submitted on behalf of the petitioner that he is in custody since 31.3.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. In course of investigation his name has come. From perusal of para89 of the case diary it is evident that petitioner was put on T.I.P. but he was not identified.

On behalf of the State, it is submitted that petitioner's name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the

No.42970 of 2015 (3) dt.24-11-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions JudgeIII, Khagaria, in connection with Chautham P.S. Case no. 36 of 2015 giving rise to S.T. no. 200 of 2015.
