This is an application for bail in connection with Special Case No. 20 of 2016, arising out of Mansi P.S.Case No. 257 of 2016, corresponding to G.R.No. 2681 of 2016, registered for the offences punishable under Sections 8/20(B)(2)(C) of the NDPS Act.
It has been submitted on behalf of the petitioner that petitioner has been falsely implicated in this case only because she has come to visit the place of the accused person and she has nothing to do with the alleged recovery of ganja and she is Rani Devi, rather Dropati Devi has been arrested in the name of Rani Devi and she is in custody since 20.12.2016.
Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.15177 of 2017 (3) dt.06-04-2017 2/2 for bail stating that from perusal of FIR appears that house of the co-accused Chandan Singh has been raided and 21 kg. of ganja has been recovered and on that petitioner was also seen concealing some packets of ganja and arrested.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
However, as the petitioner is a lady and is in custody, learned trial court is directed to expedite the trial. Accordingly, this application is dismissed.
