ANJANA MISHRA ORAL ORDER 24-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.07.2019 in connection with Excise Case No.811 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were from under the seat where the petitioner was sitting and not from the conscious possession of the petitioner. It is further submitted that the petitioner has got no criminal history.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC.
