Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 379/34 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that the petitioner no. 1 in drunken condition came to the house of the informant and abused and assaulted her and her family members. Petitioner no.2 assaulted her brother with lathi and snatched golden chain of worth Rs.50,000/-. petitioner no.3 assaulted the informant's brother with dab causing him injury.

Patna High Court CR. MISC. No.1027 of 2022(2) dt.21-07-2022 2/2 Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Parties are agnate and scuffle took place on account of dispute regarding the homestead land. Instant case is counter version of Gopalpur Police Station Case No. 139 of 2021 lodged by the wife of petitioner no.1 against informant side. Petitioners have got no criminal antecedent. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Gopalganj in Gopalganj Police Station Case No. 138 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
