JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-406 & 420 of the Indian Penal Code.
Petitioner is said to have taken loan of Rs. 1,15,000/- from the informant but did not return the same in spite of several requests, made by the informant.
Learned counsel for the petitioner submits that even if, prosecution story assumed to be true, then also, the facts of the present case, constitute the dispute of civil nature. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.37396 of 2016 (2) dt.08-09-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dawath P.S. Case No. 18 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj.
