The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 and 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

It is a case of recovery of liquor from a Tata Sumo vehicle.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been apprehended at the spot and nothing has been recovered from the conscious or constructive possession of the petitioner and he has no concern with the seized vehicle.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Muzaffarpur in connection with Kudhni (Turki O.P.) P.S. Case No. 510 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
