JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, vide paragraphs-29 and 30 of the case diary two witnesses disclosed that petitioner had taken Rs. 3 lacs as loan from the deceased and quarrel had taken place between the deceased and petitioner prior to the alleged occurrence. Later on, co-accused were arrested and confessed their guilt disclosing the involvement of the petitioner in the present crime.
Learned counsel for the petitioner submits that except confessional statements of co-accused as well as above stated
Patna High Court Cr.Misc. No.43461 of 2015 (3) dt.22-12-2015 2/2 suspicion, there appears to be nothing against the petitioner. Taking into consideration that except confessional statement, suspicion and some call details, there appears to be nothing against the petitioner and moreover, co-accused Sanjeet Kumar Singh @ Makhan and some others having more or less similar allegation have already been granted privilege of bail, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bikramganj in connection with Bikramganj P.S.Case No. 213 of 2014.
