JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with R.P.F. Post Patna Junction Case No. 2727 of 2016, registered for the offence punishable under Section 160(b) of the Railway Act.

Allegedly, the petitioner dashed the boom of the Railway gate and damaged the same, resulting, gate was not properly functioning and in that way the petitioner has caused loss of Rs, 2,500/-.

Submission is of false implication and he is ready to pay the damage amount, due to rush of vehicle the incident was caused, there was no intention to damage the boom of the Railway

Patna High Court Cr.Misc. No.13598 of 2017 (2) dt.30-03-2017 2/2 gate and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. submits that if the petitioner deposits Rs. 2,500/- then lenient view can be taken. In the facts and circumstances as stated above, the petitioner is directed to deposit Rs. 2,500/- in the Court of learned A.C.J.M., Railway, Patna and then the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., (Railway) Patna Junction, in connection with R.P.F. Post Patna Junction Case No. 2727 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
